Introduction

These Terms and Conditions ("Terms") govern your use of our website and participation in any expeditions, programs, or services (collectively, "Services"). Our Services are intended for adults aged 18 and above. By accessing this site or signing up for any expedition, you confirm that you have the legal capacity to enter into this agreement.

Use of Website

This site is intended for individuals over 18. By accessing it, you warrant that you are legally capable of entering binding contracts. You agree not to use this site for any unlawful purpose, to solicit unlawful acts, to infringe on our intellectual property, or to transmit malware or harmful code. We may terminate your access at any time for violations of these Terms, without notice or liability.

Expedition Participation &
Assumption of Risk

By signing up for any expedition, you acknowledge that:

• Activities involve inherent risks including physical exertion, exposure to extreme conditions, injury, and in rare cases, death.
• You are participating voluntarily and accept full responsibility for your health, safety, and well-being.
• You will sign a mandatory waiver of liability before attending any expedition.
• You confirm that you are physically and mentally capable of completing strenuous outdoor challenges.

We reserve the right to deny participation to anyone we believe may jeopardize the safety or group dynamics of the expedition. We strongly recommend consulting a healthcare professional before booking to confirm your fitness for these activities.

Payment Terms

Fees are stated in USD at the time of booking. For payments in other currencies, we use the exchange rate from Google Finance at 12:00 PM UTC on the day of payment. You are responsible for any conversion fees charged by your payment provider.

• A non-refundable deposit is required to secure your spot.
• Full payment is due by the date specified during the booking process.
• If payment is not received on time, your spot may be released.
• All payments are processed securely through third-party providers. We do not store your full payment information.

Cancellation &
Refund Policy

• Deposits are non-refundable.
• More than 60 days before departure: 50% refund of remaining balance, minus non-recoverable costs.
• 30–60 days before departure: 25% refund of remaining balance, minus non-recoverable costs.
• Less than 30 days before departure: No refund.

No refunds will be issued for unused portions of expeditions due to participant withdrawal mid-trip. We recommend purchasing trip cancellation insurance.

In cases of force majeure — including pandemics, wars, terrorism, government restrictions, or severe weather — we may cancel or postpone an expedition. You will be offered the choice to transfer your payment to a future expedition or receive a refund minus non-recoverable costs.

Submit your request in writing to hello@man-uncharted.com within 7 days of the triggering event. Include your name, service details, and reason. We will respond within 5 business days and process approved refunds within 14 days via the original payment method.

Privacy &
Data Protection

We handle your personal data in line with global privacy standards including GDPR, CCPA, PIPEDA, LGPD, and Australia's Privacy Act. Your information is collected solely to deliver and improve our Services, stored securely, and not shared without your consent except as required by law. Your data will never be sold.

By joining an expedition, you consent to limited use of photos or videos captured during the trip for marketing purposes, unless you explicitly opt-out by contacting us at hello@man-uncharted.com prior to departure. For full details, see our Privacy Policy.

Insurance

You are responsible for obtaining personal travel insurance covering medical evacuation, trip cancellation, and accidents. While some programs include Search & Rescue (SAR) coverage, this does not replace your personal insurance. The Company assumes no responsibility for loss, injury, or damages incurred during travel or participation. Proof of adequate insurance may be required prior to departure.

Limitation of Liability &
Participant Waiver

This is not a resort vacation. It is an off-grid, high-intensity experience in unpredictable environments. You will be required to sign a detailed Waiver of Liability, Assumption of Risk, and Indemnity Agreement before participating. Refusal to sign will result in immediate removal without refund.

To the fullest extent permitted by law, Chasing Excellence LLC (dba Man Uncharted), its founder, affiliates, employees, agents, and contractors are not liable for any injury, loss, damage, delay, accident, illness, death, or any other claim arising from your participation — whether from wilderness conditions, extreme sports, wildlife, weather, equipment failure, personal negligence, or third-party actions.

• Physical and mental challenges carry inherent risks.
• Medical services may be limited during the expedition.
• Evacuation, if needed, may be delayed and is not guaranteed.
• You are responsible for your own physical and mental preparedness.

Class Action Waiver

Any legal action you bring against Chasing Excellence LLC will be on an individual basis only, to the extent permitted by law. You waive the right to participate in any class action or representative action related to any dispute with us.

Dispute Resolution

If an issue arises, contact us first at hello@man-uncharted.com — we'll aim to resolve it informally. Unresolved disputes will be governed by the laws of the State of Wyoming, USA, without regard to conflict of laws principles. Any disputes shall be resolved exclusively in the courts of Wyoming.

Intellectual Property

All content produced by Man Uncharted — including preparation plans, expedition curriculum, website materials, logos, images, videos, text, and branding — is our intellectual property. Unauthorized use, reproduction, or distribution is prohibited. If you believe any content infringes your copyright, contact us at hello@man-uncharted.com.

This website may contain links to third-party sites. Chasing Excellence LLC is not responsible for the content or accuracy of any linked third-party sites. Inclusion of these links does not imply endorsement, and your use of such sites is at your own risk.

Testimonials featured on this site reflect the personal experiences and opinions of individuals who have used our Services. They are used with permission and may be collected from various platforms including email, Instagram, and WhatsApp. Individual experiences may vary. Testimonials are not a guarantee of results.

Code of Conduct

We foster a culture of mutual respect, integrity, and accountability. By joining an expedition, you agree to:

• Respect the group, leaders, and local communities.
• Follow Leave No Trace principles.
• Avoid disruptive or unsafe behavior.
• Follow all instructions related to safety and group dynamics.
• Not provide false information during intake or payment.

Violations are determined at the discretion of expedition leaders and may result in removal without refund. You may appeal any decision by contacting hello@man-uncharted.com within 7 days.

Governing Law

These Terms shall be governed by the laws of the State of Wyoming, without regard to conflict of laws principles. Any disputes shall be resolved exclusively in the courts of that state. If any provision of these Terms is found unenforceable, the remaining provisions continue in full force.

Changes to These Terms

We reserve the right to update these Terms at any time. Continued use of the site or participation in Services after updates constitutes acceptance. We will notify you of material changes via email or website notice at least 30 days in advance where feasible.
